Towards financial compensation for victims of domestic violence ?

Case to Watch: Ahluwalia v. Ahluwalia before the Supreme Court of Canada

Can damages for family violence be awarded in the context of divorce proceedings? Me Ilona Garaix sheds light on this case, which could well transform family law in Canada.

In Ahluwalia v. Ahluwalia, the former wife was awarded $150,000 in damages for the abuse she suffered during the marriage, both physical and psychological. This unprecedented decision of the Ontario Superior Court opened the door to the possibility of compensation for family violence within divorce proceedings, thereby providing a valuable remedy for survivors of intimate partner violence.

The case was heard by the Supreme Court of Canada on February 11 and 12, 2025, and answers to several fundamental questions are awaited:

❓ Should family violence be recognized as a distinct ground for compensation in divorce proceedings?
❓ What criteria should be applied to determine the amount of damages?
❓ Does this recognition open the door to new remedies for victims of intimate partner violence?

The outcome of this case could significantly influence how courts address intimate partner and family violence in divorce matters nationwide. A decision to watch closely. We will keep you informed of any developments.
